Police Station Consultations

Having the police knock at the door is a distressing and disorienting experience. Often, people say things in the heat of the moment that they cannot explain later. For many years the police used this to their advantage to elicit confessions from suspects during questioning.

Under the Criminal Justice (Scotland) Act 2016, all persons arrested by the police have the right to consult a solicitor before and during their interview.

Know your rights – call your solicitor

This consultation can take the form of a telephone conversation if the solicitor is unable to attend the station at which you are being held.

MJS are happy to take these calls and advise you of your rights throughout the process of being interviewed. It’s important you are fully informed of your rights at every stage and that you do not waive your right to legal assistance. In many cases, a person who has misspoken at police station has come to regret it at trial. We’ll try to prevent this to ensure that you get a fair trial.
