Theft, in Scots law, is ‘the taking or appropriating the property of another without the true owner’s consent and with the intent to deprive the owner of that property.’ This is a straightforward definition at first glance, but theft is an offence with many subtle variations.

For instance, theft can be committed by finding property and failing to return it, or it can be committed even where the accused person fully intends to return the stolen property.
Theft can also be ‘aggravated’ – common aggravations include breaking into a house or other lockfast place. Aggravations may lead to an increased sentenct.
