Over £17,000 confiscated from cannabis grower

Earlier this week a confiscation order for £17,149 was made against a Cambuslang man previously found guilty of growing cannabis.

In 2010 police received intelligence that the man was involved with cannabis cultivation at his home address. A warrant was executed on 13th November 2010 and he was found to have been cultivating on his property. He admitted ownership of the cultivation to the police and stated it was for personal use. 

He pled guilty to a contravention of Section 4(2)(a) of the Misuse of Drugs Act 1971, and on 18th May 2011 was sentenced to 180 hours community service.

“Regardless of the fact that the accused stated that the cannabis cultivation was for personal use, McGregor’s conviction for this drugs offence places a significant burden on him to account for any unexplained income,” explained Lindsey Miller of the Serious and Organised Crime Division.

“The accused was made subject to the scrutiny of specialist teams from law enforcement and the Crown, and his entire financial record for the six years prior to his arrest was assessed.

“He was found to be unable to provide a legitimate source for £17,149.39 of his income, and today a confiscation order has been made for the entirety of that total.”

A Confiscation Order is an order made by the court following criminal conviction, to pay a fixed sum of money from the proceeds of crime. An application for confiscation is one of the tools at the disposal of the Crown under the Proceeds of Crime Act 2002 and Proceeds of Crime (Scotland) Act 1995.
